YMCA MEMBER RELEASE AND WAIVER OF LIABILITY
In connection with my or our application for membership with the YMCA of Metropolitan Chattanooga ("YMCA"), I, for myself and/or family members or other applicants which I represent, acknowledge and agree to the following terms and conditions:
Member Assistance
Before beginning use of any program, service or activity as a member, all applicants are encouraged to contact the YMCA facility and ask to schedule time with a connector (for programs, camps, activities and services) and/or trainer (for fitness) to (i) discuss any concerns of the applicant for themselves or their family members or persons for which they are responsible ("Household Applicants") that might limit or impact the applicant's or Household Applicants' ability to safely and fully encounter, engage in or use programs, services, activities or facilities, and (ii) review recommendations for the safe and proper use of or engagement with same. IN ADDITION, FOR APPLICANTS OR HOUSEHOLD APPLICANTS THAT HAVE PHYSICAL OR OTHER LIMITATIONS THAT SHOULD BE KNOWN BY THE YMCA, RESPONSIBLE APPLICANTS ARE DIRECTED TO CONTACT THE YMCA FACILITY AND ASK TO REVIEW WITH A CONNECTOR OR TRAINER (AS RELEVANT) LIMITATIONS APPLICABLE AND THE DEVELOPMENT OF SPECIFIC GUIDELINES OR RESTRICTIONS GOVERNING HOW THE APPLICANT AFFECTED SHOULD ENCOUNTER, ENGAGE IN OR USE PROGRAMS, SERVICES, ACTIVITIES OR FACILITIES ("GUIDELINES"). All applicants are encouraged as well, after becoming members, to raise with a connector or trainer any limitations or conditions that might subsequently develop for applicant or Household Applicants and as needed develop Guidelines. If an applicant or member fails to schedule time with a connector or trainer (as applicable) and review and develop Guidelines or other restrictions, it will be presumed that such applicant and as applicable Household Applicants or the member have no limitations that would impact or limit their ability to safely and fully encounter, use or engage with YMCA programs, activities, services or facilities.
Release and Waiver of YMCA Liability – All Individual Applicants
I am aware that in encountering, engaging in or using YMCA programs, activities, services or facilities, I will assume known or unanticipated risks that could lead to my injury or impairment; I am prepared to assume or encounter same as I view the benefits received as worth that risk.
I also understand that in order for the YMCA, as a nonprofit, tax-exempt organization, to offer and provide programs, activities, services, and facilities to the community on an affordable and inclusive basis, the YMCA must secure from members a waiver of claims for ordinary negligence or fault, although such waiver does not release or waive claims where injury or damage is caused by the YMCA's gross negligence or intentional wrongful acts.
As a result, in consideration for the right to voluntarily participate in the YMCA programs or events and/or use YMCA services or facilities, I agree to release the YMCA and its directors, officers and employees, from and otherwise waive all claims or causes of action for or relating to bodily injury or property damage I might sustain in connection with my use of YMCA facilities or equipment and/or participation in YMCA programs, activities, or events even if caused by the ordinary negligence of YMCA. Notwithstanding the foregoing, it is expressly agreed that this release and waiver provided will not release or waive claims for gross negligence or intentional wrongful acts of YMCA.
I understand that the terms of this Release and Waiver shall continue as a condition to my continued and future participation in YMCA programs, activities or events and use of YMCA facilities and services.
Release and Waiver of YMCA Liability – Household Applicants
As the parent, guardian or legal representative, I am aware that in encountering, engaging in, or using YMCA programs, activities, services or facilities, we will assume known and unanticipated risks that could lead to our injury or impairment. Each of us are prepared to assume or encounter these risks, though, as we view the benefit of same as worth that risk.
I also understand that in order for the YMCA, as a nonprofit, tax-exempt organization, to offer and provide programs, services, activities, and facilities to the community on an affordable and inclusive basis, the YMCA must secure from members a waiver of claims for ordinary negligence or fault, although such waiver does not release or waive claims where injury or damage is caused by the YMCA's gross negligence or intentional wrongful acts.
As a result, in consideration for the right to voluntarily participate in the YMCA programs or events and/or use YMCA services or facilities, I, for myself and to the extent permitted by law for Household Applicants, agree to release the YMCA and its directors, officers and employees, from and otherwise waive all claims or causes of action for or relating to relating to bodily injury or property damage I or we might assert based on our use of YMCA facilities or equipment and/or participation in YMCA programs, activities, or events even if caused by the ordinary negligence of YMCA. Notwithstanding the foregoing, it is expressly agreed that this release and waiver provided will not release or waive claims for gross negligence or intentional wrongful acts of YMCA.
